General Terms and Conditions (GTC)

1. Scope
These General Terms and Conditions (hereinafter: "GTC") apply to all orders placed through the online shop "plus medica-shop" of plus medica ag, Oberwilerstrasse 3, 8442 Hettlingen, Switzerland (hereinafter: "plus medica").
By submitting an order, the customer agrees to these GTC. Conflicting or deviating conditions of the customer will not be recognized. The separate privacy policy applies in addition to these GTC but is not an integral part of the contract.
2. Offer and Conclusion of Contract
The presentation of products in the shop does not constitute a legally binding offer but an invitation to treat.
By placing an order, the customer makes a binding offer.
The purchase contract is concluded as soon as plus medica accepts the order by sending an order confirmation via email or dispatches the goods to the customer. The free decision to accept this offer remains with plus medica.
3. Prices and Payment Terms
The prices listed in the shop are in Swiss Francs (CHF) and include the statutory value-added tax.
Shipping costs: Any shipping costs amount to CHF 9.– for orders under a value of CHF 100.–. Orders from CHF 100.– are delivered free of shipping costs.
The following payment methods are available to the customer in the shop:
- Credit cards (Visa, MasterCard)
- TWINT
- PayPal
- Apple Pay
- Google Pay
plus medica reserves the right to exclude or restrict certain payment methods generally or in individual cases.
4. Delivery and Transfer of Risk
The delivery area is limited to Switzerland and the Principality of Liechtenstein. Delivery is made by Swiss Post or a commissioned courier service to the delivery address specified by the customer.
Risk transfer upon delivery (milk box/drop-off):
The delivery service is entitled to leave the goods at a location specified by the customer or at a usual drop-off point (e.g., milk box, mailbox, or in front of the door) if the customer does not receive the shipment personally.
With the drop-off at the agreed or usual location by the delivery service, the risk of accidental loss or damage (including theft) passes to the customer. plus medica excludes any liability for loss or theft after successful drop-off.
If a product is not deliverable due to force majeure or delivery bottlenecks, plus medica will inform the customer immediately and, if applicable, refund any payments already made.
5. Duty to Inspect and Warranty for Defects (Guarantee)
The customer is obliged to inspect the delivered goods immediately upon receipt of the delivery.
Notification of defects:
Obvious defects (especially transport damage or incorrect deliveries) must be reported to plus medica immediately, but no later than within 5 days after receipt of the goods, in writing by email (info@plusmedica-shop.ch).
Warranty:
If a defect exists, the customer is entitled to subsequent performance. plus medica decides at its own discretion whether the defect will be remedied by replacement delivery (delivery of a defect-free item) or reduction (reduction of the purchase price). Repair is excluded due to the nature of the goods (dietary supplements).
Damages caused by improper handling or storage by the customer are excluded from the warranty.
6. Voluntary Right of Return (Withdrawal)
Independent of the statutory warranty rights, plus medica grants the customer a voluntary right of return.
The customer can return the received goods without giving reasons within 14 days after receipt.
Conditions for the return:
- The goods are unused, undamaged, and complete.
- The goods are in the unopened original packaging (especially mandatory for dietary supplements for hygienic reasons).
- The return shipment is at the customer's expense and risk.

After proper receipt and inspection of the return, plus medica will refund the purchase price (excluding shipping costs) to the customer.
7. Liability
plus medica is liable for direct damages only in cases of intent or gross negligence. Any further liability, especially for slight negligence, indirect damages, consequential damages, or lost profits, is excluded to the fullest extent permitted by law.
8. Final Provisions
plus medica reserves the right to change these GTC at any time without giving reasons. Such changes do not apply to orders already placed.
Swiss law exclusively applies, excluding the UN Sales Convention (CISG).
Place of jurisdiction:
Place of performance and jurisdiction is Winterthur (ZH), unless mandatory other jurisdictions (e.g., at the consumer's place of residence) are prescribed by law.
