Scope

These General Terms and Conditions (hereinafter: “GTC”) apply to the Plus Medica Shop (hereinafter: “Shop”). By visiting and using the shop, you accept the terms and conditions as well as our legal provisions and privacy policy, which are an integral part of these terms and conditions.

General

The store’s offer may include goods and services. All sales, deliveries and other services are carried out exclusively in accordance with these terms and conditions. All questions or complaints in connection with these terms and conditions can be submitted in writing by e-mail to our consumer service (info@plusmedica-shop.ch).

In connection with order processing, Plus Medica processes, among other things, personal data provided by you. Plus Medica may use these for operational and statistical purposes. You expressly authorize Plus Medica to disclose all data necessary for the processing of your orders and the shipment of the goods (such as name, billing address, delivery address, etc.) to authorized third parties (e.g. warehouse operators, post office, delivery service, etc.). In doing so, we always comply with the provisions of Swiss data protection legislation.

Eligibility of use

The use of the shop is reserved exclusively for natural or legal persons with unlimited capacity to act who wish to order our products for their own consumption or as a gift for third parties. The data required for the order, such as surname, first name, address, e-mail address, etc., must be provided completely and truthfully.

Offer and conclusion of contract

The presentation of our product range does not constitute a binding offer to enter into a contract. By placing an order, you make a binding offer and thus also accept the applicable terms and conditions. Plus Medica reserves the right to make a free decision on the acceptance of this offer. The purchase contract is concluded by the order in the shop by the customer and its acceptance by Plus Medica. The prices on the day of the order, which are listed in the shop, apply. Swiss VAT is included in the price. Employees of Plus Medica are not authorized to verbally agree on terms and conditions to the contrary or to give any assurances. If information about an item in the range has been incorrect, Plus Medica will make you a counter-offer, the acceptance of which you are free to decide.

Delivery area

The delivery area is limited to Switzerland and the Principality of Liechtenstein.

Terms of delivery

The ordered goods will be delivered by post or delivery service. Please note that before public holidays, it usually takes longer for parcels to be delivered. Plus Medica or the commissioned delivery service is entitled to deposit the ordered goods at the customer’s front door if the customer does not personally receive the order at the time of delivery of the goods. If a product is not available or only available later due to force majeure or lack of self-delivery, Plus Medica reserves the right to withdraw from the purchase contract or to extend the delivery periods with regard to this product. Plus Medica will inform you immediately of the unavailability or the delayed delivery period. If you do not want to accept any counter-offer or if you do not want to accept a delayed delivery communicated by Plus Medica, you can withdraw from the contract. In this case, Plus Medica will reimburse you for any payments already made.

Warranty/Delivery Times/Returns

Plus Medica guarantees that all ordered products leave our warehouses in impeccable quality. If you are not completely satisfied with your order, please contact our consumer service by e-mail (info@plusmedica-shop.ch). If a delivered item is damaged or does not correspond to the ordered goods, you can return this item within a period of 14 days after receipt. The item must be sent in its original packaging and enclosed with a copy of the invoice to Plus Medica AG, Oberwilerstrasse 3, 8442 Hettlingen. If an item is not available or only available later due to force majeure or lack of self-delivery, we reserve the right to submit a replacement offer to the buyer with regard to the non-deliverable product. The buyer is free to accept the replacement offer or to withdraw from the purchase contract with regard to the non-deliverable item. Under the above conditions, Plus Medica undertakes to reimburse the purchase price paid by the buyer as well as the postage costs or to deliver another item of equal value.

Price indications and availability of products

Despite the greatest care, erroneously incorrect information cannot be completely ruled out. All product and price information is non-binding. In some cases, offers may only be available in limited numbers or not at all. Due to high demand, products can sell out quickly. Plus Medica is not liable for delays in delivery, unavailable products or erroneously incorrect price quotations. We reserve the right to make product adjustments. Scheduled offers are only valid for the specified period of time.

Payment, due date, default of payment

Payment for the goods is made by credit card or other means of payment provided in the shop. Plus Medica reserves the right to exclude or restrict certain payment methods and means in general or in individual cases.

Unfortunately, it is not possible to pay by sending cash or cheques. We exclude any liability in the event of loss.

Closing remarks

Plus Medica reserves the right to change these terms and conditions at any time and without giving reasons. Such changes do not apply to orders already placed. All contracts concluded through the use of the shop, as well as these General Terms and Conditions, are subject to Swiss law to the exclusion of international private law, in particular the Vienna Convention on Contracts for the International Sale of Goods (CISG). The place of performance and jurisdiction is Winterthur (ZH). Should any provision of these General Terms and Conditions be invalid, the remaining provisions shall remain unaffected. For questions that are not regulated in these General Terms and Conditions, Swiss law applies.
